He’s been charged with felony first-degree murder and will be tried as an adult.

McIntosh was found by her husband inside their Cheyenne, Wyoming, home on Saturday afternoon – around an hour after she was believed to have been killed, according to a Laramie County Sheriff affidavit.

He told cops he had heard a muffled popping noise earlier through headphones as he played video games but didn’t think it was serious.

Leone had stolen McIntosh’s gun from her car and threw down a notebook to distract her so he could take aim at the back of her head while she picked it up, he allegedly told police.

He started plotting the killing because he had heard his parents arguing over stolen tablet and caught McIntosh calling him “retarded” and a “thief,” according to police docs seen by the Wyoming Tribune Eagle.

McIntosh’s death was initially reported as a suicide, but detectives started investigating the teen after he allegedly opened up in a police interview.

Leone’s dad said they had had multiple incidents of him stealing from clients, and that the tablet had been missing for some time.

The morning of McIntosh’s death, she had been in her son’s room finishing a puzzle while Leone’s dad played games in the basement.

The teen was told to work on homework.

When the dad walked up to the main floor, he saw Leone standing on the landing outside his bedroom and confronted him about what was going on.

The teen allegedly responded, “I don’t know, it just went off.”

Leone’s dad rushed back down to the basement to get his phone and called 911 at around 12:46 pm.

He then ran back upstairs and tried to perform life-saving measures on his wife, but she wasn’t responsive, the court documents read.

The dad claims he saw the gun nearby, sitting beside the puzzle, which he thought was confusing because it was normally kept in her car.

Leone told police that he had stolen the firearm in the past and had previous ideations about killing McIntosh when she didn’t do what she wanted, court documents allege.

Leone’s dad admitted feeling hesitant to tell cops his side of the story, as he couldn’t bear the possibility that his son killed his wife.

“I don’t want to think what I think happened […] I don’t even want to put it into words,” he allegedly told police.
